Ark Tribe Back In Court - July 20

Ark Tribe will be back in court Tuesday July 20 after the matter was adjourned 16 June.

During that time the magistrate twice adjourned the case after the defence, who originally argued the case should be thrown out on the grounds the ABCC had not correctly begun the prosecution – as the proper authority did not exist.

Lawyers for the Commonwealth DPP contested the argument and the magistrate moved for an adjournment. Both sides made written submissions on the matter.

The magistrate conceded that although the proceedings were vaildly brought by the defence, he asked that the case continue as planned.

The defence lawyers will now continue their defence of Ark after he pleaded not guilty.

Ark Tribe, a normal construction worker allegedly accused of failing to attend an interrogation by the Construction Star Chamber for the Australian Building and Construction Commission (ABCC) has repeatedly said thanks to the many thousands of people who continually show their support.

Rallies have again been organised across the country (see below for details) as workers, members of the broader community and unionists voice their growing anger and condemnation at the treatment of Ark and against the ABCC.

CFMEU National Secretary Dave Noonan has repeated his calls for the ABCC to be abolished and said, "If Ark goes in; construction workers across the country would go out."

The matter is set for July 20, 21 and 22.

  • Perth, WA – March to office of ABCC, Perth Esplanade (near glass pyramid), 10am
  • Warrnambool, VIC – Cannon Park, 10am
